After 5 months. Denied..:

Letter said due to capias history and driving record . Which I have a couple failure to reinstate charges and a couple capias because I forgotten to pay the fine. No felonies. Violent crimes. Drugs. None of that. Is it even worth fighting?


Didn't see online that those were reasons for denial

I would consider getting your record cleaned up. It may take a few bucks to hire a lawyer. Well worth it in my opinion because it could bite you in the a$$ for other things. Employment...mortgage....etc

So what kind of lawyer should I talk to? Kinda stupid I can buy a own a gun legally. But due to capias for unpaid fines I can't conceal carry. This state is ass backwards

Capias still open or were they discharged when you paid the fines? Was that before or after you applied for a CCDW permit? Did you know about these before you applied?

What county are you in?

No open capias. Last was has been over 2 years ago. Try all went away when I paid fines off. Never arrested for them. I knew about them but didn't know capias for traffic was a reason for denial. And im in new castle county

I have a misdemeanor in 2004
And a misdemeanor for contempt of court almost 3 years old. None of which are listed for reasons of denial

Sounds like taking time to get your record cleaned up (expunged?) might help.




And by the way, I was denied for far less, and I lost my challenge hearing, so don't feel too bad.

I'm not a lawyer, so I have no idea. I don't know how those things in your record affected the decision.

BUT if you do want to proceed with the challenge, get a lawyer to help you. Or even go into the hearing with you.

Considering contacting this attorney. He is a member of the Delaware Association of Second Amendment Lawyers (of which I am a member) and I know he has been successful in these hearings before. At least consult with him.

I second recommendation for Anthony Delcollo. Also, Delaware Association of Second Amendment Lawyers website has a "Contact us" tab. They were supposed to post a member's list, but haven't done so yet. Ask for members in your county. See http://www.DASAL.org , 302-655-3667.
My guess is that they keep members names close to the vest, because of crackpot anti-2A and animal rights people. I was at last year's Annual Mtg. and anti-hunter had to be escorted out of the room! This year's meeting was limited to "Attorneys Only" . I didn't attend.
Also, be aware that Attorney General's office has an investigator to review applications (one of the reasons it takes so long, he's overwhelmed !- just my guess), so it may have been investigator's bias / opinion / recommendation to judge that got you denied.
