Hey everyone!

This site has been great for educating myself on the laws!
I am new to DE and just bought my gun yesterday (Sig Sauer P320)! Previously came from NJ.... and everyone knows what their laws are like.

So I would love to get my concealed carry permit, but since I have only resided in the state for about 3 months I have a couple questions that I hope you lovely folks can answer.

1. Does not living here for a year hurt my chances at getting the permit? When I got my gun the guy at the store mentioned that if you haven't lived here for a year the state requests your driving record from your previous state. Anyone know if that is true (guess that is two questions in one)? Not that I care if they get it though.

2. I know 3 people (from work) that live in my county. Would I be able to get away with using those 3 as referrals and then 2 others from out of state? Or is that a hard must be in state/same county referral rule?

I do like that you can open carry here with out any issue. Though I am a bit hesitant to do so right now. Maybe eventually. Thanks in advance for answering my questions!

First off, Welcome and congrats from escaping commie territory!

1. I am unsure of what the residency "term" for obtaining a CCDW in DE actually is. All I remember is that you have to be a resident. So if you've established that, then the first part is done. Maybe someone more knowledgeable can speak up on the part of how long you must reside in the state.

2. Those 3 people in your county will work as good references but the other 2 will not. All references must be people other than family and reside in your current county of residence. IIRC, they also generally look for references to have known you for at least a year or more but I'm not sure that is a "requirement."


OC is a great way to effect your 2A rights here in Delaware until such time as you decide to or are able to obtain your DE CCDW. We have a meeting/dinner coming up on Thursday. Come on out and hang out with us, get to know us and have a good time! OC is generally less nerve racking the more you do so and easier if there is a group of like minded people around. If you'd like info on a CCDW class, I have contact info for an excellent course and great instructors who will teach you everything you need to know! Shoot me a PM if you'd like that info.

Thanks! Yeah, I know a few friends that got some guns in Jersey, but it took them a few months just to get approved for the license to buy them. Was nice walking into a store, picking out a gun, then walking out with it in half an hour!

I figured that referrals must be in the same county, but thought I had read about people using out of state referrals so I wanted to make sure. Ah well, I suppose until that time I know enough people I will work up some courage to open carry!

Where are you all meeting up on Thursday?

Welcome!

You will need a FULL notarized driving record from NJ since you've been here only 3 months.

The 3 people you know, are they married? Do their spouses know you? If so use em.

When you are ready for the class, let me know. We have them monthly.

I heard from Resident Judge Witham in Kent County that the three resident judges generally require that you know your references for at least one year (which means that you probably need to have resided/worked in Delaware that long). It is unclear whether that "unwritten rule" would be upheld if challenged. Moreover, Judge Witham did indicate that there are exceptions to the "rule."

One is married, though I have never met his wife so that won't work unfortunately.

I have known the three people for about a year (will be a year in May). I work in PA actually and moved to DE just a couple months ago. So its a big of an odd situation.

So I have only been out once so far. Went to Targetmaster (I believe that is considered Chadds Ford) right inside the PA border (its close to where I live). Open to go wherever though!
