A friend who in in construction was recently laid off and needed to file for unemployment and asked me if he can carry(he has a de ccdw license) in the Wilmington office since it's not in the best part of killmington and the clientele is questionable ... I believe he said its in an old sears on market st...

I read through the law link posted in the forum...title 11 (I think it was) listed a couple places ..parks and such..but not post offices which I know are not allowed..then I looked through all 9 pages and saw references to DMV being ok... But none to this location specifically .....any advice on where to look or a definitive answer would be greatly appreciated..thanks guys!

If you think the old Sears building is in a bad neighborhood you really need to get out more. Technically it's not even in the city limits but really close since across the street (Lee blvd) and the houses behind it are in the city. The city doesn't get wild and dangerous until you get down to 35th street.

As far as carrying into that building I don't think there's any law prohibiting it, nor metal detectors to stop it.

I was relaying his sentiment...me personally given my life experiences..I don't find killmington scary...but I can see where others might... He said he went and cced without problem.... I did find this on deccw in my search to not to see him get jammed up

There are a few inaccuracies in this list.

1. The Casinos are NOT listed as a place prohibited in Title 11. Prohibition on carry is a policy/regulation, not law.
2. Delaware State Fair is NOT listed as a place prohibited in Title 11. Prohibition on carry is the policy of the property owners, not Law.

Two comments:
1. The Red and Green font colors are missing
2. In my opinion, DE schools are not off limits to DE CCDW permit holders. IANAL. There are some exceptions, e.g., a UD student is not permitted by school regs.

Title 18 USC 922q2a
(2)(A) It shall be unlawful for any individual knowingly to possess a firearm that has moved in or that otherwise affects interstate or foreign commerce at a place that the individual knows, or has reasonable cause to believe, is a school zone.
(B) Subparagraph (A) does not apply to the possession of a firearm—
(i) on private property not part of school grounds;
(ii) if the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political subdivision of the State, and the law of the State or political subdivision requires that, before an individual obtains such a license, the law enforcement authorities of the State or political subdivision verify that the individual is qualified under law to receive the license;

Pulling the DE thread, here's what it appears to be (IANAL). 1457 says firearm in school zone is a 1442 violation but 1442 isn't violated if you have a CCDW permit.

DE Code Title 11 Crimes and Criminal Procedure
Ҥ 1457. Possession of a weapon in a Safe School and Recreation Zone; class D, E, or F: class A or B misdemeanor.
(a) Any person who commits any of “the offenses described in subsection (b) of this section, or any juvenile who possesses a firearm or other deadly weapon, and does so while in or on a "Safe School and Recreation Zone" shall be guilty of the crime of possession of a weapon in a Safe School and Recreation Zone.
(b) The underlying offenses in Title 11 shall be:
(1) Section 1442. -- Carrying a concealed deadly weapon; class G felony; class D felony.”
“§ 1442. Carrying a concealed deadly weapon; class G felony; class D felony.”
“A person is guilty of carrying a concealed deadly weapon when the person carries concealed a deadly weapon upon or about the person without a license to do so as provided by § 1441 of this title.”

Actually, my apologies for a tersely worded comment intended as a caution for future readers not as a criticism of your post which contains valuable information. The deloc carry brochure lists courthouse prohibitions in paragraphs addressing contraband which I had to read twice to comprehend. lol. I also have not yet found the state building rules.

No worries...I didn't take it that way...being very versed with nj law..and having read the convoluted mess of words they have at least 100 times....the de laws seem pretty straight forward and I ...while reading through the statutes I couldn't find where STATE offices/blds were no carry locations...federal yes...state no....saw that post on the deccw site ...but with no link to the statute...just the color coding saying "it is state law" vrs corporate policy..
