DC Sued After Trampling Second Amendment…Again

WASHINGTON, DC – The District of Columbia is once again being sued over the blatantly unconstitutional licensing regime enacted by the DC council designed to keep residents from exercising their Second Amendment rights.

The lawsuit stems from a series of other litigation that overturned DC’s ban on owning handguns and a subsequent case forcing DC to recognize the word “bear” in the “keep and bear Arms” part of the Second Amendment. Unhappy with the result of those cases, the District enacted laws making it very hard for an average DC resident to buy and keep a gun in the district and nearly impossible for residents to obtain concealed carry permits.

The lawsuit, filed by Alan Gura, the lawyer who brought the previous two cases challenging DC’s unconstitutional ban on handguns, says, “The Second Amendment right to bear arms includes the right to carry functional, loaded handguns in public areas for the purpose of self-defense.”

“This right, like others, is subject to some degree of regulation, but its status as a right precludes the government from regulating it out of existence or forcing individuals to prove their entitlement to its exercise.”

The concealed carry licensing regime requires that residents provide proof that they require a handgun to defend themselves, creating a licensing scheme that allows the DC government to arbitrarily deny citizens their constitutionally protected rights. Then, even if a concealed carry permit is issued, the law was crafted so that permit holders can easily run afoul of the law, which includes provisions such as no permit holder can come within 1,000ft of political officials or face arrest.

DC’s gun control scheme, much like Maryland’s, is a reflection of the racist and classist views by Democrats that no one other than the wealthy, politically connected elites should have the ability to defend themselves. It is utterly shameful that democrats continue to trot out a strategy on gun control pioneered by the Ku Klux Klan.

The racist spin here is the one thing I do take exception to. Roots, yes, many or all of the anti gun roots WERE racist in nature. I agree 100%. But these days, the places that are heavy anti gun are blanket screwing everyone, regardless of skin color. White, black, or purple, dc doesn't want you to carry. Ditto NJ CA NY. Il until it was forced on them.

Interesting read about Gura fighting to get dc to pay legal costs when they lose. Google if you're bored.

This shows yet another great example to the rest of us who cherish not only our 2A rights but every right protected by our beloved Constitution that we should never stop fighting for them... that we always need to stay vigilant and stand up for those ideals and beliefs that made America the greatest nation it is today!! :sparring:

the last few months have put this case back in play, and not for "good", pro-2a, reasons.

don't like the ruling, find a way to get the judge disqualified. then find one you think will be more to "your", a2a, liking.

D.C. gun case gets new judge after appeals court ruling

WASHINGTON (AP) — A new judge has been assigned to oversee a case about the District of Columbia’s strict gun laws.

Online records show the case was assigned Tuesday to Judge Colleen Kollar-Kotelly, who was appointed to the federal bench in Washington in 1997 by President Bill Clinton.

Kollar-Kotelly replaces Judge Frederick Scullin Jr., who was appointed by President George H.W. Bush. Scullin’s initial ruling in the case had been in favor of the gun law’s challengers.

In December, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled that Scullin should not have been overseeing the case.


The New York judge had been given authority to oversee a handful of Washington cases. One involved the city’s gun law, but the list didn’t include a follow-up case.

another update. appears they tried to "judge shop" and the new judge, Leon, presumably one ALLOWED to hear this case has heard it. And agreed with Scullin.

in other news, in cali, 9th circuit, the found the attempting to zone gun businesses out of existence is not permitted, and that selling guns is protected to some extent by the 2a.

not sure how big these steps are but at least they are some movement in a good direction.
