Chapter 89: FIREWORKS AND FIREARMS

§ 89-1. Fireworks prohibited.

No person shall store, sell, offer or expose for sale, or have in possession with intent to sell or to use, discharge or cause to be discharged, ignited, fired or otherwise set in action within the town limits, any fireworks, as defined under Title 16, Delaware Code § 6901.

§ 89-2. Minors prohibited from use of BB, pellet, air and paintball guns without adult supervision.

No person under the age of 18 shall display, fire or discharge or display in or on or into any street, highway, alley or public place in the Town, any rifle, gun, pistol, revolver, cane, cannon or other appliance, whether projecting or exploding any bullet, cartridge, blank cartridge, cap, as described in Title 16, Delaware Code § 6902, including-those commonly referred to as BB, pellet, air, or paintball, without adult supervision.

§ 89-3. Firing or discharging of guns and other appliances prohibited in residential and public areas.

No person shall fire or discharge any rifle, gun, pistol, revolver, cane, cannon or other appliance as noted in § 89-3 above, within 100 yards of any residence, except that of the owner, nor shall any be discharged within 15 yards of any public road.

§ 89-4. Fireworks permitted for frightening birds from crops.

Nothing in this chapter shall prohibit the use of fireworks used solely and exclusively for the purpose of frightening birds from crops, and use of such shall be governed by rules and regulations prescribed by the Delaware Department of Agriculture.

§ 89-5. Violations and penalties.

A. Any person violating any of the provisions hereof shall be deemed guilty of a misdemeanor, and upon conviction in a court of competent jurisdiction shall be fined not less than $25 nor more than $100 and shall pay the costs of prosecution, including Town Attorney fees and Victim's Compensation Fund assessment.
B. For the purposes of this chapter, each day that a violation continues shall be deemed to be a separate offense.
