Lawsuit re: possession of firearms in DE State Parks - Page 3 - Delaware Open Carry

Evidently a DE Supreme Court appeal has been filed:

A lawsuit questioning the constitutionality of a gun ban in Delaware's state parks has been shot down by a Sussex County Superior Court judge.

But the gun advocates challenging the ban aren't giving up. An appeal was filed in Delaware Supreme Court Jan. 9, said attorney Francis Pileggi of Wilmington-based law firm Eckert, Seamans, Cherin and Mellott.

Yeah...I think that was fully anticipated. Would have happened no matter what the result of the Superior Court case was. Someone was going to appeal.

For those following this, the appeal to the Delaware Supreme Court of the lawsuit over the ban on possession of firearms in Delaware state parks and forests has been scheduled for oral argument on Wednesday, September 13, at 11:15 am.

You can read the briefs here (click on the "Upcoming Arguments" tab, and search for "Bridgeville Rifle"), including the amicus curiae briefs (one supporting the state from the Law Center to Prevent Gun Violence, three supporting reversal from the NRA, a law-enforcement group and a group of Delaware state legislators).

In past years, oral arguments have been live-streamed as they occur; I'm not sure if that's going to continue. However, a video recording will be available within a few days after the argument.

Thanks for the heads up!

Very nice.

Interesting that a cursory read of the dissent shows the minority fails to understand the respect criminals have for the law. (None)

I wish we could be as proud of our federal judiciary as we can be of the majority in this case.
